SITUATION
The land is situated to the east of the popular village of Lanlivery and north of the ancient stannary town of Lostwithiel - each being about a mile. Lanlivery offers a public house, church and primary school, and Lostwithiel an interesting array of shops, together with public houses, restaurants and a station on the London Paddington line. Fowey, with its renowned sailing waters, is about 6 miles to the south and there is a junction to the A30(T) about 6 miles to the north at Bodmin.

DESCRIPTION
The sale presents an opportunity to purchase a regular shaped parcel of pasture land.

The approach is over a right of way (see Right of Way paragraph below) and mains water is available (see Services below). The land is in good heart, on a gentle south-easterly aspect and is fenced.

The views from the land are far-reaching and take in the rolling countryside of the area, the River Fowey and the sea in the distance.

In total, the land extends to about 1.20 acres (0.49 hectare).

COMPLETION DATE AND SOLD AS SEEN
The completion date Friday 8th September 2023. The land will be sold as seen.

BUYERS AND ADMINISTRATIVE FEES
The successful buyers of each lot will be liable to pay the sum of £5,000. From this, a Buyer's fee of £2,400 inclusive of VAT is retained by Stags/Bamboo Auctions as a condition to the online platform costs, and £2,600 forms part of the 10% deposit. An additional administrative fee of £600 inclusive of VAT, will be payable by the successful Purchaser immediately after the auction.

DEPOSIT PAYMENT
The Seller and Buyer agree that the winning Bidder may transfer the remainder of the 10% deposit (less the amounts paid online) within 48 hours of the end of this online auction. Clauses 6.1, 6.2 and 7.1 of the Holding Deposit Agreement shall be read as amended to reflect this accordingly.

The payment to be made via the buyer's solicitor to the vendors solicitor. We therefore recommend all bidders clear Anti Money Laundering Regulations with their solicitor prior to the auction.

DEFINITION OF AUCTION AND GUIDE PRICE
Guide price(s) is an indication of the Seller's expectation. Reserve price(s) is a figure below which the auctioneer cannot sell the lots at auction. We expect the reserve will be set within the guide range. Guide prices may change at any time prior to auction.

PROOF OF IDENTITY
Under Money Laundering Regulations 2007, it is a requirement for Estate Agents to perform due diligent checks to any person who intends to bid at auction. There is a requirement for all bidders to register via the online sales site and complete the ID checks. There is no charge for registration.

COVENANTS
The property is sold subject to a covenant precluding the use of the land for any form of tents and yurts or for the erection of any turbines and there to be no more than one touring caravan on the land at any one time.

RIGHT OF WAY
The Purchaser will be granted a temporary right of way over the area shown hatched on the attached plan for identification purposes only. It is intended that a new access will be created over the area shaded blue. Once, and only when created, the temporary right of way over the hatched area between points A and B will be relinquished.

DIRECTIONS AND WHAT THREE WORDS
From Lostwithiel, take the A390 up out of the valley towards St Austell. At the top of the hill turn right towards Bodmin. Drive for about 500 yards and bear sharp left in front of the Green Cart Farm sign. Drive for about 50 yards and the entrance to Green Cart Farm will be seen on the right-hand side. SERVICES
Mains water - the Purchaser will be granted a right to enter the land adjoining to the south-east for the purposes of connecting to mains water and laying a pipe to the land, subject to making good all damage caused.
